The case, Wirth v. Wirth (Docket Nos. V-14928-05, V-15046-05), was resolved by the Supreme Court of the State of New York, Appellate Division's Second Judicial Department. Salamone's client, who was divorced from her husband in 2005, had sought permission from the Suffolk County Family Court to move with the couple's child from Long Island to Florida, for economic reasons and for family support. The family court denied that permission, so Salamone appealed the decision to the appellate court and won.
